Contract of 1330 (Helmand River Delta Commission)
In this regard, the Governments decided to accept US mediation to resolve their dispute. In the contract precedence of drinking water of Sistan rather than other uses was accepted by neutral Commission; the amount of needed water of Sistan was announced 22 cubic meters per second by the board that the Iranian government did not agree.
Contract of 1351
According to this contract, Iran's water rights was 26 cubic meters per second and it was decided that a facility be established on the river by agreement between the two countries, and Afghan guaranteed providing water rights of Iran. This agreement was signed by one agreement on the Helmand River and two protocols a on 22 March 1351.
Helmand matter since the contract of 1351 till now
In June 1352, as result of a coup, monarchy of the Afghan was changed to the Republic, and finally, in June 1356, Government of Afghanistan declared the treaty to be done. After this date, following repeated coups in Afghanistan and the many inner issues of the country, there were no measures evident that indicate the next governments of Afghanistan's idea on this issue. During the Taliban the Helmand river path was closed on Iran, and despite geopolitical shifts in the region and regime change in Afghanistan it is still kept closed, while the Iranian Sistan region has faced a severe shortage of water and drought for several years.
During negotiations between officials of the two countries in recent years, the Iranian government wants to run the contract of 1351 again, which is not executed properly by Afghan authorities, and the government of Iran practically cannot even have the rights in this contract whereas the volume of water behind the Kajaki dam (dam on the Helmand River in Afghanistan) is estimated to be 5.1 to 5.2 billion cubic meters.
Treaty of 1317
In the contract, the Governments agreed to divide the region from Band Kamal Khan to Bandab equally and for not using water from Chahar Borjak village to Band Kamal Khan, the Afghan committed that in mentioned area he will not build or repair streams.
The Afghan government's non-compliance to the contract caused water shortages in Sistan to be continued. This problem was increased especially by digging Nahr-e Baqra and Saraj in Afghanistan that clearly opposed the Treaty of 1317 and Goldsmith arbitration. Over the years, Iran has been trying to re-start negotiations with the Afghan government, but the negotiations did not lead to something positive, even in 1326, Afghanistan used Helmand dehydration and turned all the remaining water upon their land, in a way that the inhabitants of Sistan suffered from drinking water.
