Why the theory of jurist rule is considered to be the only form of the religious government?
First, let us see, what type of message the theory of VELAYATE-FAGHIH contains for us? In short, what can be said about the said matter is this: when infallible Imam is no having rule, the jurists who have special conditions and are selected by the infallible Imams are responsible to manage the society on the basis of Islam.
Two characteristics of the government:
We know that every government has some targets such as: supplying the needs of the citizens, establishing the internal security, relationship with other countries to ensure the national security and many more, so every government should poses two type of characteristics, the first one is to know, how to achieve these objectives, and in this way, manages the community to reach to the said goals. And the second one is, the government should be trusted by the public. It means that, the citizens must be sure that, in the shadow of the government, their honor, life and property are in safe. Every human with any type of belief, assumes that these two conditions are must for every government. And expects that, the rules, acts in such a way to cover these requirements.
If government is the religious one, in addition to the said issues, government must consider another target and that is preparing a field for spiritual growth of the citizens. This target is important and affects other targets, this goal is the first priority in the Islamic system. Now with attention to the differentiation of the religious government from other governments, who can be the leader of the Islamic system and meet the above targets? As in the religious government, managing the government, should be based on the Islamic laws and whose ever is in the power, must have adequate knowledge of Islamic law, so that in governing the community, can`t disregard. This familiarity, have to be in the level of a jurist. The first condition of the religious leader is being expert in religion. The necessity of this condition is very clear, because every representative of the law, should be fully aware. And among Muslims, jurists are having most information and awareness about legal rules.
The second condition is moral and virtue. Because if the ruler is not having virtue, the power will destroy him. Any may keep the personal interests, above of the society`s interests. For every ruler in any type of government, honesty and trustworthiness are the must, so by this way, citizens are handing over the nation`s affairs to him with trust. But for the religious leader, piety and honesty are compulsory.
The third condition is awareness and dedication to the social interests. He should know, how to handle the situation. He should know the international relations and recognizes the internal and external enemies and friends. These are the necessary skills for every ruler, otherwise he will face many problems. There may be other terms and conditions, set forth in non-FAGIH, but the condition of jurisprudence, forces us to have a legitimate ruler. The said rules were confirmed by the religious leaders. IMAM ALI EBN ALI TALEB about this issue have advised us and said: the most qualified person for the government is the fellow who is mightier in knowledge and wiser in God`s command. Due to these conditions, we are claiming our legitimate government, must be jurist government.
