Reasons for invalidity of mandate of Palestine and Jewish Agency

Mandate for Palestine is invalid for three reasons:
1- The first reason of being invalid is that acknowledging Balfour Declaration and accepting the formation of a national Jewish homeland in Palestine have violated the Palestinian people's sovereignty, human rights, and autonomy of them. Palestine has been the Palestinian national home from immemorial time. So the establishment of a national home for an alien race in the country is a clear violation of fundamental constitutional rights of its people. The League of Nations and the government of Great Britain also have no legal power to give Palestine to the Jews, or give them political or civil rights. Since the mandate sentence without considering the license recognized rights for foreign Jews in Palestine is legally void.
2- The second reason of mandate being discredited is its violation in terms of meaning and words with the Article 22 of the League Covenant that is causing it. The violation is considerable in three opinions:
a. Covenant of the League of Nations has known Mandate as the best way to ensure development, progress and welfare of the people of territories under the mandate.
Is the Mandate for Palestine done for the welfare and progress of the Palestinian people? Of course, the answer is no, and it was performed vice versa. So that the mandate sentence set the establishment of a national homeland for strange nation as against rights and aspirations of the Palestinian people, and asked the guardian to put the country under such political, administrative and economic conditions so that this becomes a national homeland. It demanded them to try in facilitation of Jewish immigration to Palestine. While Lord Islington opposed the Balfour Declaration in the mandate, said:
The Mandate for Palestine is actual deviation from the principles of Mandate.
The same person adds:
When a person finds out that Article 22 ... the welfare and good of the people must be guaranteed in the form of a kind of sacred duty and when it is considered as an interpretation of the mandate. I think that when we delay a self-rule state in Palestine to be filled with alien race, everyone will acknowledge that we are strongly away from this goal.
B. the Mandate for Palestine is opposite of a special concept of Mandate in Article 22 for countries that broke away from the Ottoman Empire in the First World War. The aim of mandate for these countries was that the mandate is limited to counseling and temporary cooperation. However, it is doubtful that the Palestinian people, like other countries that separated from the Ottoman Empire, needed consultation and cooperation because the level of their culture and civilization at the time was not less than many of the countries that were members of the League of Nations. These were the same Arabs who actually cooperated with the Turks in ruling the Ottoman Empire. Their political and administrative experience was not less than the Turks, who had the rule.
C. granting the Mandate for Palestine to Great Britain was unlike the Covenant of the League of Nations, because in accordance with the provisions of Article 22, satisfaction and demand of the people of the territory in under the mandate was a key consideration, and in this case it was ignored.
3- The third reason of discrediting this mandate is based on the fact that verification and implementing Balfour Declaration contradicted promises that Great Britain and other allied governments gave Arabs during World War I. Violation of giving independency to the Palestinian people and submission of their country to foreign immigrants was a clear violation of this promise.
Israeli military prospects were increased by Arabs' Revolt during mandate era, because the United Kingdom allowed the Jews to become legally armed for the first time. 20,000 Jews declared their readiness to take up arms. "Haganah", Jewish especial army that was established with the full support of Great Britain, started making weapon and bringing them to Europe and stashing them in Palestine. Concurrent with this action, United Kingdom disarmed Arab citizens to prevent their rebellion. In the 1930s, as a result of Nazi policies against Jews, feeling of support of Zionism grew among the Jews of Europe, but still the majority of Jews were opposed to the move. Jewish Agency and World Zionist Organization tried to ensure that immigrants Jews go from Europe to Palestine.
One of the main objectives of the mandate and Zionism was undermining the economic and financial strength of Palestinian Arabs and to control the Palestinian economy. In the years of mandate, many Jewish, English and Americans capitalists were encouraged to immigrate to Palestine. Entrance of America and Britain's industrial technologies to support Zionism in Palestine, transformed the Jews' industry and agriculture. Between 1932- 1941, approximately 25050 capitalists entered Palestine with wealth more than a thousand pounds sterling. Also from 1919 to 1936, by encourage of Great Britain more than 400/000/000 dollars were invested in Palestine. English - Palestine Bank had turned into the official bank of Zionists during the Mandate. In 1936, the number of 5602 various plants belonging to the Jews in Palestine were active. By the way, Jews strongly opposed employing Arabs in their organizations.
In addition, from the beginning of the occupation of Palestine, the UK appointed pro-Zionism English officials to Palestinian political and administrative key positions. Shortly after the occupation of Palestine, "the Office of the enemy's occupied territory" was established in where Jewish officers and characters and businessmen were hired. The heads of these institutions were also all pro-Zionism.
Mahatma Gandhi is also said about the mandate (in 1939):
The Arabs' impose by the Jews is wrong and inhuman. What is happening today in Palestine cannot be justified with any moral standard of behavior. Provisions of mandate will finally have no commentator other than war. This will reduce the number of Arabs so that a part or all of Palestine is given to the Jews as the national homeland, which is a crime against humanity.
As a result, the Mandate for Palestine supported the interests of alien people instead of local interests of the country, and caused great injustice to the Palestinians. It is noteworthy that all these things were done under the guise of achieving grandiose objectives of the Covenant of the League of Nations and promoting the welfare and development of people. Therefore discrediting of this mandate is apparent.
The Jewish Agency
Herzl believed that the implementation of the Zionism programs should be given to the two organizations: A Jewish community and a Jewish company. Jewish Community was crystallized in the World Zionist Organization. The idea of a Jewish Company also evolved and turned into political services and enforcement of the World Zionist Organization's plans in relation to establishing Jewish homeland and it was called Jewish Agency.
Wiseman in his speech drew the attention of members to the expanded Jewish Agency that the Zionist central committee had held in Congress in 1922. He stressed:
Our task and demand is that we recognize the Jewish Agency as unity factor of all the Jewish people, because the people who live and work in the field of Jewish identity must have a representative in the Jewish Agency. It is the duty of Congress to find ways and solutions that equip the Executive Committee to the power to achieve this ambitious goal. We must communicate with the leading Jewish organizations to obtain their cooperation in the Palestinian Territories. I believe that these efforts may culminate with the World Jewish Congress.
During the evening of 31 August, Wiseman suggested to members that the decision can be approved:
1- Central Council of Zionism with deep satisfaction welcomes Article IV of the Mandate document for Palestine.
2- . Central Council of Zionism declares that Zionist Organization agrees with the powers and duties of the Jewish Agency and the Zionist Executive Committee of Palestine accepts responsibility of the Jewish Agency.
3- Central Council of Zionism must appoint the Executive Committee document in order to pursue the implementation of Article IV of mandate to do every possible effort for the cooperation of all determined Jews to help the Jewish national home. The Council also declares tendency of Zionist Organization to admit that the Jewish Agency is representative of the entire Jewish nation.
On May 19, 1929, the Jewish Council of America held General Assembly with presence of nearly 250 members and approved a resolution in support of efforts of Zionist Organization to expand the Jewish Agency. The following objectives were considered as major goals:
1- Encourage to migrate;
2- Promoting the Hebrew language and Jewish culture;
3- The purchase of land as an eternal possession of the Jewish people;
4- Employing Jewish workers in all fields supervised and by Jewish Agency, by the condition that improve of the farming colonial is done with the efforts of Jewish agricultural workers.
The Jewish Agency, which was founded in 1929 by help and collaboration of Britain, such as an administration service was active parallel to the administration service of Great Britain and coordinated Immigration and Jewish settlement issues and its key political part supervised how things go in Arabic part of Palestine and made its relationship with the Palestinian Arab leaders in and out of Palestine.
According to the Jewish Agency's operation in Palestine under mandate was turned into the country in another country. In addition to numerous large-scale land ownership, the Jewish Agency also provided agricultural budget and had commercial and industrial facilities. Arabs had hoped that through a movement that relied on the villagers mostly, can put pressure on the UK to stop the question of Jewish immigration and land purchase. In Arab cities, committees were set up to organize union strikes and actions for failure to pay the tax.
In 1937, Britain approved the Emergency Defense Regulations, and imprisoned the Arab rebels without charge and deported them.
Here is a very important point and that is during the mandate period until 1948, the Jewish Agency and after that the Israel that are both sides of a coin have always been in the back of incidents of terror and panic and were the executor of the plans. The largest massacre which revealed the truth was Kafr Qasim's massacre. This spirit flowed in the body of Zionist organizations and when these organizations become Israel or were absorbed and merged inside it, brutal beliefs moved toward their goals and they were supported in this direction by large organization or the so-called Israel.
In summary, we shall say that in mentioned times, the situation in Palestine was in favor of Jews. They had facilities and technical, political, economic and cultural tools and received abundant foreign aids. Before World War II, the vast majority of Palestinian industries (electricity, cement, tobacco and textile) were in the hands of the Jews. They always seized fertile lands and gradually replaced growing citrus industry by citrus agriculture of Arabs. Their population was rising by the immigrants as well.
