Introduction:

Islamic Revolution on February 1979, demolished one of oldest imperial systems in Iran.
And upon royal ruins and king political thought, founded Islamic Republic by the doctrine of the Supreme jurist rule by Imam Khomeini (RA).
Theory of VELAYAT-e FAGHIH, is a thousand years old, and although Shiites did not agree about all details, but always have spoken about it. IMAM KHOMEINI, is one of the persons who talked about it. Theory of Imam believes in vast rule of jurist, with all the responsibilities which holy prophet of Islam, MOHAMMAD (PBUH) had. This kind of attitude was shown in all his writings and oral works. The book of KASHEFOL ASRAR (1902), which can be taken in to the account, is the origin and good example for this theory.
After the victory of the revolution, the Islamic Republic despite many problems inside and outside, got further stability every day. Stability increasing and development of several issues, conditions and requirements gave more chances to the leader to show more aspects about this theory during his ten years rule over the country.
On 6 January 1988, Imam has clearly talked about jurist issue in his message. There were some rare understandings about this message. Some fellows think, this theory has been emerged at this time.
This article seeks to assess such hallucinations.
The main hypothesis of this study, as described:
Theory of absolute clerical rule, theoretical and practical view of Imam Khomeini has ancient stability and consistency.
Final providing and full declaration of it, has been formed gradually according to time and place.
Moreover, the sub hypothesis are proving the accuracy of the main one.
The main hypothesis, help communicate the sub hypothesis are as follows:
1- Theory of absolute clerical rule, due to religious jurisprudence, based on the time and place.
2- People and their unique capabilities. Maturity of the people to accept the jurist rule is important.
3- Clergy specific capabilities are very important to cooperate in this matter.
4 –emergency situation in starting days of Islamic revolution victory was the reason to announce the idea, gradually.
In this article, we are not discussing, about kindness of VELAYAT or help and victory. We talk regarding the ruling of VELAYAT.
In BAHRUL OLUM book, we can see the meaning which says about interference of especial person. Clergies believe the interference is on body or property or both of them.
One of the fundamental discussions about the supreme leader, is his jurisdiction.
Imam Khomeini, believes that the Supreme Leader should have all the powers of the prophet (PBUH) and his government should control even pray, fasting and haj issues.
Principle 110 of the Constitution with eleven sections will not close the hand of Supreme Jurist to enter other sections. Base on the principle 57, VALI is the ruler upon the constitution.
Professor AMID ZANJANI writes: in the Iranian constitution, there is word for the power of jurist, and that word is absolute (MOTLAGHE), this means, jurist has entire power in the constitution.
Imam Khomeini in the ALBEI book, explains about distribution of some part of FAGHIH`s power to others. He believes that the leader must cooperate with experts to do the works in better way. He mentions about the Imam Ali who done the same thing.
One more thing is leader will not do everything according to his own wish, but he performs works according to Islamic principles.
Some say leader can select the court judges but can`t choose the war commander.
No limitations other than the interests of the people and the law of God. And norms and standards in the field of Islamic law.
Some fellows are believing in some controls over the leader, such as financial control, character control and law control.
Leader consults all kind of experts in all subjects about country issues.
Supreme perspective limitations in the view of Imam Khomeini (RA)

A - Credibility of FAGHIH

Imam (RA) matches the arbitrary powers of the prophet.
Nobody is forging Caliphate for scholars in order to forge the Imams.
B - Absolute clerical rule, subject to the law of God.
Even Absolute clerical rule with wide power should obey the Islamic law, the law which opposes dictatorship.
In 1980 and after passing the constitution, immediately, Imam announced that all, whether jurist or simple fellow, are under protection of law.
C - Supreme Leader, is committed to the common good.
He has to think about profit of the society and leave his own interest.

Imam in ALBAI book says:

Leader`s option will not vote for tyranny, but the interest of Islam and Muslims
:
In the eyes of Imam Khomeini, the Supreme Leader should do monitoring on everything and everywhere.
He must control the Islamic system, even though he is not in the government. Imam repeatedly was saying:
We value our people and we must stand by the entrance to supervise good and evil things.
The Shiite political jurisprudence, the supreme leader, has a long history. Late NARAGHI wrote:
There is no clergy who has doubt in jurist`s rule.
Ayatollah Yousef SANEI says: except one or two people, no one said that jurist can`t rule.
Religious leaders have different opinions about authority power of the VALI.

Some have given their opinion as:

1 - Retaining property of orphans, fools and maniacs.
2 - Protect the property of the absent people who due to the absence can`t custody their own property.
3 - Some of the matters related to marital, such as coupling daffy fellows.
4 - Maintain the property which belongs to Imam (AS), unknown property without heirs.
However we have to admit the fact that no-one discussed about Shiite Islamic government like Imam Khomeini.
Theory of absolute clerical rule, was extended by Imam and no one gave wide explanations like him.
When ALAME NARAGHI was writing his own article about VELAYAT FAGHIH, he was hopeless regarding Islamic government. When constitution was made in Iran in 1980, there was no word of jurist. But later, and president was responsible for connection of three sections of the powers. Later, principle 15 was added and mentioned about jurist and his power as the fifth one and the power which connects all the powers of the government. Then according to the principle 57, the word guardianship was replaced by the leadership.
After reviewing the 1368 Constitution, absolute supreme Leader was changed by the supreme leader.
If we look at the orders of Imam Khomeini, we can see the power of jurist in his hand. When king has made a rule by name of state associations. Imam ordered to people to close the markets to show an opposition movement against the regime. This action showed the power of a jurist, even he was not having the government in his hand. And now another example about the power of jurist:
The struggle of Imam Khomeini in November of 1964, during Speech against capitulation, Imam as the leader of Muslims, disagreed with acceptance of the capitulation by the parliament members. Imam as the responsible leader cancelled the power of BANISADR as the president. Because as the VALI, he felt this man is dangerous for Islam and Muslims.
In response to questions from foreign reporters about his job in the new government after the Islamic revolution`s victory, Imam has repeatedly stated: I am just monitoring. I will not accept any government job. I will be as before. Imam Khomeini has tried his level best to show the real face of Islam and how to run a government with Islamic rules. Meanwhile he as a religious leader was respecting other religions. We should not forget that he constructed the first pure Islamic government in the world. He allowed to clergies to work with non-clergies to work together and use their abilities to improve the country. Imam Khomeini as VALI FAGHIH showed best relationship with other countries. In the war he advised Iranian pilots not to do bombardment on the civil areas and fight with only army men of the enemy. In every aspect he should the best way to reach the best result according to Islamic rules and regulations.
